06. 06.01.2021 Heard Mr. P.K. Jena, learned counsel for the Petitioner and Mr. S. Mishra, learned Standing Counsel for Opposite Parties by Video Conferencing mode. This writ petition has been filed challenging the assessment order dated 26[th] December, 2017 passed by the Deputy Commissioner of Income Tax, Exemptions, Bhubaneswar. Learned counsel for Petitioner seeks leave to withdraw the writ petition with a liberty to pursue the remedy of a statutory appeal. In view of the above, the writ petition is dismissed of as withdrawn with liberty to the Petitioner, as prayed for. If an application is moved for condonation of delay in filing the appeal, the Appellate Authority shall consider the same in accordance with law. As prayed by the learned counsel for the Petitioner, the original impugned order forming part of this writ petition will be returned to the Petitioner by substituting it with an attested photocopy thereof. As there are certain restrictions due to pandemic COVID-19 situation, learned counsel for the parties may utilize the soft copy of this order available in the High Court’s website or print out thereof at par with certified copies in the manner prescribed, vide Court’s Notice No.4587, dated 25[th] March,2020.
