JUDGMENT
Pending appeal against the assessment oder under the IncomeTax Act, the petitioner filed Ext.P3 application before the 1[st]respondent requesting that the petitioner may be treated as not indefault, till disposal of the appeal. The petitioner seeks expeditiousdisposal of Ext.P3 and to stay coercive recovery proceedings forrecovery of the tax disputed in the appeal in the meanwhile.
2.I have heard the learned Standing Counsel for the IncomeTax Department also.
In the facts and circumstances of the case, I dispose of this writpetition with a direction to the 1[st] respondent to consider and passorders on Ext.P3, as expeditiously as possible, at any rate, within onemonth from the date of receipt of a copy of this judgment. Till ordersare passed on Ext.P3, coercive proceedings for recovery of the taxdisputed in the appeal shall be kept in abeyance.
