02.11.2015 Heard Mr.A.C.Mohanty, learned counsel for the petitioner and Mr.S.K.Acharya, learned Sr.Standing Counsel for the Income Tax Department. This writ application has come to be filed seeking stay of demand levied during pendency of the statutory appeal.
Admittedly, the First Appeal has been filed and the order of attachment was vacated by this Court vide order dated 27.4.2015 on account of the fact that the amount has already been collected by the Revenue pending disposal of the First Appeal.
Therefore, the present writ application stands disposed of in terms of our interim order and the Department shall take expeditious steps to dispose of the First Appeal. No coercive action shall be taken against the petitioner enforcing the demand pending disposal of the First Appeal.
Free copy of this order be handed over to the learned counsel for the Income Tax Department. Urgent certified copy of this order be granted on proper application.
