THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON21.10.2022, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
JUDGMENT
The petitioner has approached this Court being aggrievedby the fact that the assessing officer under the Income TaxAct, has by Ext.P5 order required the petitioner to pay a sumequivalent to 20% of the tax assessed as a condition for stayon further recovery proceedings. The petitioner has filedExt.P4 appeal against Ext.P2 order of assessment before theNational Faceless Appeal Centre. However the petitioner hasnot filed any stay petition before the National Faceless AppealCentre.

It is the case of the learned counsel appearing for
the petitioner that in the light of Ext.P7 judgment of thisCourt, the petitioner is not required to deposit the amountequivalent to 20% of the tax assessed as a condition for stay.
3.Heard the learned Standing Counsel appearing forthe respondent department also.
4.Having heard the learned counsel appearing for thepetitioner and the learned Standing Counsel appearing for therespondents, this writ petition is disposed of directing therespondents to provide a link to the petitioner for uploading
stay application in Ext.P4. This shall be done within a periodof two weeks from the date of receipt of certified copy of thisjudgment. The petitioner shall file a stay application within10 days from the date of receipt of the link. If such stayapplication is filed within the time stipulated above, recoveryproceedings to recover any amount under Ext.P2 shall be keptin abeyance till a decision is taken on the stay application sofiled by the petitioner. The Appellate Authority shall whiledeciding the stay petition also have regard to the findings ofthis Court in Ext.P7 judgment.
The writ petition is disposed of as above.
