JUDGMENT
Ext.P1 is an order of assessment issued against thepetitioner under the Income Tax Act for the assessment year2008-2009. Aggrieved by this order, the petitioner filed Ext.P2appeal and Ext.P5 stay petition, which are pending considerationof the second respondent. Meanwhile, his property has alsobeen attached under Ext.P4. It is in these circumstances,apprehending coercive action by the department, the writ petitionis filed.
2. I heard the counsel appearing for the petitioner and also
the standing counsel appearing for the respondents.
3. Taking note of the pendency of the Ext.P2 appeal, the
second respondent is directed to consider the same in accordancewith law and pass orders thereon. This shall be done asexpeditiously as possible, at any rate, within three months ofproduction of a copy of this judgment. In the meantime, further

proceedings pursuant to Ext.P1 will stand stayed subject to thecondition that the petitioner paying Rs.10 lakhs on or before25.03.2012.
Writ petition is disposed of as above.
