07. 12.12.2018 W.P.(C) No. 4912 of 2018 & Misc. Case No.4207 of 2018 Heard learned counsel for the parties. By way of this writ petition, the petitioner has challenged the conditional order passed by the Income Tax Officer, Office of the Pr. Commissioner of Income Tax (Central), Visakhapatnam, in his letter dated 20.3.2018, under Annexure-2 and prayed for quashing of the said order dated 20.3.2018 since the appeal filed by the petitioner under Section 246A of the Income Tax Act, 1961 is pending. On perusal of record, it is seen that the Court had granted interim order on 28.3.2018, which reads as under: “ W.P.(C) No. 4912 of 2018 & M. C. No.4207 of 2018 28.3.2018 Mr.R.S. Chimanka, learned Senior Standing Counsel enters appearance on behalf of the opp. Parties-Income Tax Department by filing Vakalatnama on their behalf in Court today. The Vakalatnama be kept on record. Copy of the writ application has already been served on Mr. Chimanka, learned Senior Standing Counsel. Mr. Chimanka, learned Senior Standing Counsel prays for one week time to obtain the record from the office of the Principal Commissioner of Income Tax (Central), Visakhapatnam. List this matter on 09.04.2018. Operation of the order under Annexure-2 shall remain stayed till the next date. MP Urgent certified copy of this order be granted on proper application.” Considering the submission made, it is directed that the interim order granted by this Court dated 28.3.2018 shall continue till disposal of the appeal.
