CORAM: THE HON’BLE THE CHIEF JUSTICE AND THE HON’BLE MR JUSTICE B. P. ROUTRAY
ORDER
09.04.2025
1.The grievance raised in the instant writ petition pertains to
delayed disposal of the statutory appeal filed before the Commissioner of Income Tax (Appeal), National Faceless Appeal Centre.
2. The order of the Assessing Officer (AO) is assailed by the
petitioner. But till date, no attempt is made on the part of the Appellate Authority to dispose of the same. We are not unmindful of
the fact that there has been a spate of litigations filed before the
Appellate Authority yet we cannot overlook the fact that a litigant
has a right to have adjudication on a speedy basis.
3.Considering the plight of the petitioner and that the appeal
is pending for a considerable period before the Appellate Authority,
we, therefore, request the Appellate Authority (Opposite Party No.1)
to expedite the hearing of said appeal and efforts must be made to bring it to its logical end within three months from the date of communication of this order.
4.With the aforesaid observation and direction, the present writ petition is disposed of.
An urgent certified copy of this order be issued as per rules.
