This writ petition is in respect of the order of stay dated 08.05.2015 passed by theAssistant Commissioner of Income Tax, Central Circle-06, New Delhi in respect of theassessment year 2011-12, whereby the stay of recovery of the demand, was rejected. Thelearned counsel for the petitioner points out that an application for stay has also beenmade before the Joint Commissioner and the same is pending.
In view of this, we are disposing of this writ petition to enable the JointCommissioner to take a decision in the matter. A request has been made by the learnedcounsel for the petitioner that the Joint Commissioner be directed to dispose of the matterat the earliest.
We have also heard Mr Sawhney for the revenue. He submits that a reasonabletime may be granted for disposing of the stay application by the Joint Commissioner.
We direct the Joint Commissioner to dispose of the stay application in accordancewith law within four weeks from today. Till such time, no coercive measures be taken bythe respondents.
The writ petition stands disposed of.
