J U D G M E N T
Petitioner is an assessee under the Income Tax Act(the Act) on the rolls of the first respondent. Aggrieved byExt.P2 assessment order, the petitioner preferred Ext.P3 appealbefore the second respondent. After the institution of the writpetition, it stated that the petitioner preferred an applicationfor stay in Ext.P3 appeal. It is alleged by the petitioner in thewrit petition that proceedings have already been initiated forrealisation of the amounts covered by Ext.P2 order. Thepetitioner, therefore, seeks appropriate directions in thisregard, in this writ petition.
2.Heard the learned counsel for the petitioner asalso the learned Standing Counsel for the respondents.
Having regard to the facts and circumstances of thecase, I deem it appropriate to dispose of the writ petitiondirecting the second respondent to take a decision on theapplication for stay preferred by the petitioner in Ext.P3 appeal,
within two months from the date of receipt of a copy of thisjudgment. Ordered accordingly. Needless to say that until ordersare passed on the application for stay, further proceedings forrealisation of the amounts covered by Ext.P2 assessment ordershall be deferred.
