This writ petition has been filed by the petitioner challenging the order passed by Income Tax Appellate Tribunal, Delhi Bench ‘E’ Delhi in MA No. 153 (Del)/2005 (in ITA Nos. 4259 & 4260 (Del)/2003) on 16.12.2005. Against this order the appeal is provided under the Income Tax Act. Instead of statutory remedy available under the Act, the petitioner has directed this writ petition.
Since the remedy of appeal is available, therefore we are not inclined to entertain the petition. The petition is dismissed in limine.
