Heard learned counsel for the parties. Mr. H.M. Bhatia, learned Senior Standing Counsel appearing for respondent nos. 1 to 4 would submit that the order passed by the Commissioner of Income Tax (Appeal), Dehradun was served on the Department on 20[th] of this month only, and the Department will certainly give effect of the order, and if it is found that there is no outstanding demand as on date, the refund shall be made, in accordance with law, at the earliest.
Recording the statement given by Mr. H.M. Bhatia, learned Senior Standing Counsel received by him under instructions, the writ petition is closed.
There will be no order as to costs.
