Can I claim HRA if it's not in my Form 16?

If HRA is a component of your salary but your employer didn't give the exemption (Form 16 shows it as taxable), you can still claim the HRA exemption directly in your ITR with rent proof. If you get no HRA at all, claim the Section 134 (old 80GG) rent deduction instead. Both are old regime.

If HRA is part of your salary

The employer not considering it (because you didn't submit rent proofs) does not stop you — you can compute the HRA exemption (old Section 10(13A)) yourself and claim it in the ITR. The exempt amount is the least of: actual HRA received, rent paid minus 10% of salary, or 50%/40% of salary (metro/non-metro).

  • Keep rent receipts and the rent agreement.
  • If annual rent exceeds ₹1 lakh, you need the landlord's PAN.
  • The reduced taxable salary you report will differ from Form 16 — that's fine; keep the proof for any query.

If you get NO HRA (rent = 0 in salary)

You can instead claim the rent-paid deduction under Section 134 (old 80GG) — least of ₹5,000/month, 25% of total income, or rent minus 10% of income — provided you (and spouse/minor child) don't own a house where you live and you receive no HRA.

Regime note

Both HRA and 80GG are old-regime only — neither applies in the new regime. Compare old vs new before choosing.
