Frequently asked questions

Can one employee working from India create a PE?
It can, depending on what they do. Someone habitually negotiating or concluding contracts on your behalf is a far greater risk than someone doing back-office work. The facts decide it, not the job title.
Does using an employer of record protect us?
Not automatically. An EOR solves employment law and payroll; it does not by itself prevent a PE if the person is functionally acting for you in India.
What is the consequence of having a PE?
The profits attributable to the Indian activity become taxable in India, with a return to file. Discovered late, it usually comes with interest and penalty exposure.
How long does a review take?
